As the work of a US Federal employee I believe it should be in the public domain.
 
Several photographers have interpreted the lack of copyright protection for images in Afghanistan as meaning that they could claim all the rights on unpublished images from Afghanistan, or on images that had previously only been published in Afghanistan, if they were the first party to publish the image outside of Afghanistan.
 
To the best of my knowledge this contention has not been tested in court.
