The US legal doctrine that there are, for practical purposes, limitations to the application of normal copyright infringement remedies in the interest of natural justice. These limitations were codified to that time in Title 17 U.S.C. Section 107

Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair[1]:

  1. the purpose and character of the use;
  2. the nature of the copyrighted work;
  3. amount of the copyrighted work used, measured quantitatively and qualitatively; and
  4. the effect of the use upon the commercial value of the copyrighted work.
